Can a foreigner buy property in Montenegro?

Yes. A foreigner buys an apartment, a house or a building plot on the same terms as a citizen, with no restrictions by nationality. Agricultural land, forest, land on islands and within 1 km of the land border cannot be bought — except a plot of such land up to 5,000 m² together with the house on it.

What taxes does the buyer pay?

Real estate transfer tax: 3% up to €150,000, 5% on the part from €150,000 to €500,000, 6% above €500,000. The return is filed and the tax paid within 15 days of the contract. A new build bought from the developer is exempt — 21% VAT is already included in the price.

How much do the notary and registration cost?

The notary fee is fixed by law since April 2026: €480 for a contract up to €120,000, then +€13 for each started €15,000, plus VAT. Registration in the cadastre is about €15. A court translator, if needed, is extra.

What is the annual property tax?

The municipality sets it. In Herceg Novi it is 0.25% of the assessed value if this is your main home and you are registered there, and 0.55% for a second home. It is paid in two instalments: by 30 June and by 31 October.

Does buying give a residence permit?

Yes — temporary residence for 1 year, renewable. Since 17 January 2026, new applications require the property value in the transfer-tax decision to be at least €150,000; this does not apply to citizens of the EU, Norway, Iceland, Liechtenstein and Switzerland. To renew, you must show the taxes were paid. This permit does not allow work — a separate permit is needed.

How do I pay for the property?

Under amendments to the anti-money-laundering law (from 12 May 2026, according to the press), a deal over €10,000 can be paid only through an account at a Montenegrin bank, otherwise the notary will refuse it. Open the account in advance: banks often turn down non-residents without a residence permit. The money can be placed in the notary's deposit — the notary releases it to the seller after signing.

How does the deal work and how long does it take?

Usually there is first a preliminary contract at the notary and a deposit, typically about 10%: if the buyer backs out, the seller keeps it; if the seller backs out, he returns double. Then the main contract at the notary, the tax return and registration in the cadastre. A foreigner without residence in Montenegro gets a tax number and appoints a tax representative. In practice it takes 4–8 weeks from agreement to registration.

Can I buy through a company?

Yes: a Montenegrin d.o.o. can be set up with capital from €1. But a company's home is always taxed as a second home (0.55% a year in Herceg Novi), and a company has accounting costs. Decide with a lawyer for your situation.

Do banks give mortgages to foreigners?

Some do, on stricter terms than for locals. Lovćen banka — up to 10 years with a deposit of at least 50% of the loan. Hipotekarna banka — up to 10 years, 20% down payment. CKB — only with a residence permit and a job in Montenegro.

Do I need a visa?

From 1 November 2026 Montenegro introduces visas for citizens of Russia, Belarus, China, Turkey and Saudi Arabia. Ukrainian citizens enter visa-free for up to 90 days. You can complete the deal without coming — by a notarised power of attorney.

Why an inspection if a notary handles the deal anyway?

The notary checks the form of the deal and the parties' rights. He does not look at cracks, damp, wiring, disputes with neighbours or prices of similar properties nearby. And a house up to 300 m² is not subject to any official technical inspection by law. Our inspection covers exactly this.
